12. Partial nullity
Any provision of the Terms of Use which, in whole or in part, conflicts with mandatory Swiss law shall be severable and any invalidity, in whole or in part, of any such clause shall not affect the validity of the remainder of the clause in question or of the other clauses of the Terms of Use. Should any provision of the Terms of Use prove to be ineffective in whole or in part, it shall be replaced by a provision that produces economic and legal effects as close as possible to those of the invalidated provision.
13. Miscellaneous
The Terms of Use constitute the entire agreement between Le Bal des Créateurs and you with respect to your access to and use of the Site and the Content.
The fact that Le Bal des Créateurs tolerates breaches by you of one of your obligations under the Terms of Use, or does not require the application of a right that is recognized to Le Bal des Créateurs by the Terms of Use or by law, can not be interpreted as a waiver on its part to avail itself.
14. Jurisdiction and applicable law
The Terms of Use are governed by Swiss law, to the exclusion of its rules of private international law.
The exclusive place of jurisdiction is Lausanne, subject to appeal to the Swiss Federal Court.
15. Language
The Terms of Use are written in French. In the event of any discrepancies, this French version shall prevail.
16. Jurisdiction and applicable law
The Terms of Use are governed by Swiss law, to the exclusion of its rules of private international law.
The exclusive place of jurisdiction is Geneva, subject to appeal to the Swiss Federal Court.
